CONSTITUTION AND BYLAWS - RIVERTON BASEBALL

ARTICLE I: NAME

This organization will be known as Riverton Babe Ruth League (D.B.A. Riverton Baseball), a Utah Non-Profit Corporation.

ARTICLE II: OBJECTIVE

Riverton Babe Ruth League, a Utah Non-Profit Corporation is organized exclusively for charitable, religious, educational and scientific purposes, including, for such purposes, the making of distributions to organizations that qualify as exempt organizations under section 501(c)(3) of the Internal Revenue Code, or corresponding section of any future federal tax code.

Riverton Baseball exists to provide baseball experiences for children of the city of Riverton. We believe that all children should be afforded the opportunity to participate in a level of baseball commiserate with their playing experience and current skill level. To these ends, we have formed two divisions in our league. The first division is the Drafted Division. The second is the AAA Intact Division. This document contains the bylaws that will govern the overarching Riverton Baseball League and each of these separate divisions.

ARTICLE III: GENERAL LEAGUE POLICIES

The following are the basic policies of this league:

  1. The Drafted and AAA Intact Divisions of the league will operate according to the rules and regulations set forth by the Wasatch Baseball Leagues.
  2. All bylaws and rules are subject to change at the discretion of the current elect board at any given time of the calendar year.
  3. To achieve our objective of providing supervised competitive games. The managers and coaches shall bear in mind that the attainment of exceptional athletic skill or inning of games is secondary and the molding of future men/women is of prime importance.
  4. The Elect Board shall have the authority to suspend any member or Manager whose conduct is considered detrimental to the best interests of the league.
  5. The President, upon evidence of the misconduct of any player in relation to the league, shall, within 48 hours, notify the division representative and the Manager of the team of which the player is a member.
  6. Said Manager or the division representative, or both, shall appear in the capacity of an advisor, with the player, before at least three members of the Elect Board within three days of the act, for disciplinary action. Said disciplinary action will consist of:
    1. Warning
    2. Probation, or
    3. Expulsions
  7. Any Manager, coach, fan or team member ejected from a game by an umpire may be placed on a one (1) game suspension, which shall be the next consecutive game.
    1. Individuals that are ejected will not be allowed on the Riverton Baseball grounds (13800 South 3600 West, Riverton, UT 84065) for the next consecutive game. If they are unable to attend the very next game, they will be required to miss the next game that they would have been able to attend. All suspensions will be reviewed by the Elect Board.
    2. If any fan/spectator is removed from the game the head coach for that team will also be removed and serve the given suspension.

ARTICLE IV: FINANCIAL POLICIES

  1. A semi-annual financial review will be conducted by the league Treasurer beginning at the end of the current fiscal year. It will be reviewed by the current Elect Board
  2. Applicable IRS forms (Form 990) will be filed yearly.
  3. Yearly budgets will be prepared by the Elect Board.
  4. The Elect Board of Riverton Baseball shall decide all matters pertaining to the finances of the league and it shall be the policy to place all income in one (1) common league treasury, directing the expenditure of same in such a manner as to give no individual or team an advantage over other as to equipment, etc.
  5. It shall be the policy of the league to accept bids, whenever possible, for the purchase of all goods and services.
  6. No purchases are to be made without prior approval of the Elect Board. Any equipment ordered without prior approval is subject to cancellation or payment to be made by the individual placing the order.
  7. Any purchase not previously budgeted for, or for new purchases of $500 or more, must be approved by a majority vote of Elect Board members available.
  8. Accounts will be set up at multiple suppliers where available. Reimbursement to Board Members must be accompanied by a company generated receipt and will be made by a check in a timely manner (NO CASH WILL BE GIVEN) or no reimbursement will be made without an official receipt or proof of purchase (credit card receipt).
  9. The Fiscal Year of the league shall start January 1 and end December 31.
  10. Refund Policy
    1. Players are eligible to receive a full refund if the request is made before the date of the draft.
    2. Requests made after the draft, but no later than 1 week following the draft will be eligible for a 50% refund.
    3. No refunds will be given after 1 week following the draft.
    4. Appeals can be made to the Elect Board after that date.
    5. Riverton Baseball offers RegSaver insurance at the time of registration. If RegSaver insurance is purchased, all refund requests must be made through RegSaver.
    6. Refunds do not include credit card processing fees and will be made via check.
    7. AAA Refund - Requests made after February 1st are eligible for a 50% refund. No refunds will be given after February 15th.
    8. Refunds are for league fees only and do not include any credit card processing fees.

ARTICLE V: MEMBERSHIP

  1. All residents who reside within Riverton and Bluffdale Cities are allowed to play in any Riverton Baseball League division providing they:
    1. Sign up online by the closing time of the registration session.
    2. Pay the appropriate fees, make payment arrangements, or receive a partial or full waiver by the Riverton Baseball Board.
    3. Are selected, after a tryout, for a AAA Intact team.
  2. Non-Resident participants will be allowed on the basis that:
    1. Their participation does not displace Riverton or Bluffdale City Residents or limit them from playing in at least two games per week.
    2. Their participation does not render a team in a Riverton Baseball division ineligible for tournament tracks in the division for which they are applying to play.
    3. The total number of non-resident players will be limited to no more than 35% of the total league makeup.
      1. Players who have been grandfathered in through continuous play in our league prior to adjustments in our boundary due to Herriman, South Jordan and Eagle Mountain will not be considered non-resident participants.
  3. No child will be discriminated against or disallowed to play based on race, national origin, sex, sexual orientation or ability to pay.
  4. Removal of participants due to field space shortages:
    1. In the unlikely event that we reach field space capacity, the following will be the order of removal of participants from our league:
      1. AAA Intact team with the lowest percentage of resident participants
        1. If teams are tied, teams will be randomly selected for removal.
      2. Non-Resident recreation participants
        1. We will place the name of all non-resident participants in a hat and draw until the number of participants is reached that will bring the league back within field space capacities.

ARTICLE VI: GOVERNMENT

All divisions of Riverton Baseball will be overseen by an Elect Board. They will be assisted in governing the league by a General Board.

  2. Riverton Baseball Elect Board Positions and Responsibilities
    1. President
      1. Serve as the official contact for Riverton Baseball for interface with City and other Government Officials
      2. Communicate league news via social media
      3. Set the agenda for Riverton Baseball Board Meetings
      4. Serve on the Wasatch Baseball Leagues Board as the Riverton Baseball representative
      5. The President has no voting rights unless to break a tie
      6. To be eligible for this position you must hold a board position for at least two years prior to running
    2. Drafted Division President
      1. Will be the President of the Drafted Division
      2. Oversee all the divisions of the Drafted Division
      3. Oversee the draft of each division
      4. Handle the schedule of games for the Drafted Division
      5. Assist Division Vice Presidents in the management of Coaches and Parents
      6. Assist the President with league communications
      7. May cast one vote
    3. AAA Intact President
      1. Provide information relevant to the needs of the AAA Intact Division teams
      2. Manage all issues relating to the AAA Intact Division Coaches and Parents
      3. Attend Wasatch Baseball Leagues meetings to serve as a leas-an.
      4. May cast one vote
    4. Secretary
      1. Take notes at all Riverton Baseball Board meetings and upload them to the shared Google Drive
      2. Organize and plan league picture day
      3. Record all votes of the board
      4. Run elections for the Riverton Baseball Board
      5. May cast one vote
    5. Treasurer
      1. Document all revenue and expenses of the league
      2. Provide semi-annual financial updates to Riverton Baseball Board
      3. May cast one vote
    6. Equipment Manager
      1. Determine equipment and uniform needs for the entirety of the Riverton Baseball League
      2. Acquire and present bids for needed equipment when appropriate
      3. Distribute equipment to Drafted Division coaches by the end of each division’s tryouts
      4. Distribute each team’s uniforms at least two weeks before games start
      5. Collect equipment at the end of the season
      6. May cast one vote
    7. Snack Shack Manager
      1. Setup account for repetitive purchase of food, apparel and other snack shack offerings
      2. Purchase supplies for snack shack
        1. Any new purchase over $500 must have board approval
      3. Hire snack shack workers
      4. Coordinate setup and breakdown of snack shack at the beginning and end of season
      5. Abide by all applicable government regulations pertaining to the snack shack
      6. Assign workers to snack shack schedule
      7. May cast one vote
    8. Umpire-in-Chief
      1. Train umpires in Riverton Baseball Umpire Academy
      2. Schedule umpires for all Riverton Baseball hosted games
      3. Rules interpretations
      4. Manage the league electronic payment method for umpires
      5. Respond to umpire complaints, comments and concerns
      6. Review all ejection reports
      7. May cast one vote
  3. General Board Positions and Responsibilities
    1. The officers of the General Board may consist of Vice Presidents and Coaches Reps. These offices hold no voting privileges except when electing the Elect Board of Riverton Baseball. The following are the age groups for which we seek Vice Presidents and Coaches Reps and their responsibilities:
      1. Quickball (3-5)
        1. Assist in team and coach assignments for the Quickball division
        2. Be the main point of contact for coaches and parents in the Quickball division
      2. Rookie 6
        1. Assist in team and coach assignments for the Rookie 6 division
        2. Be the main point of contact for coaches and parents in the Rookie 6 division
      3. PeeWee 7
        1. Assist in coach assignment for the PeeWee 7 division
        2. Run the tryouts for the PeeWee 7 division
        3. Assist in the draft for the PeeWee 7 division
        4. Be the main point of contact for coaches and parents in the PeeWee 7 division
      4. PeeWee 8
        1. Assist in the coach assignment for the PeeWee 8 division
        2. Run the tryouts for the PeeWee 8 Division
        3. Assist in the draft for the PeeWee 8 division
        4. Assist in the All Star coach and team selection in the PeeWee 8 division
        5. Be the main point of contact for coaches and parents in the PeeWee 8 division
      5. Minor
        1. Assist in the coach assignment for the Minor division
        2. Run the tryouts for the Minor division
        3. Assist in the draft for the Minor division
        4. Assist in the All Star coach and team selection in the Minor division
        5. Be the main point of contact for coaches and parents in the Minor division
      6. Major
        1. Assist in the coach assignment for the Major division
        2. Run the tryouts for the Major division
        3. Assist in the draft for the Major division
        4. Assist in the All Star coach and team selection in the Major division
        5. Be the main point of contact for coaches and parents in the Major division
      7. 13U
        1. Assist in the coach assignment for the 13U division
        2. Run the tryouts for the 13U division
        3. Assist in the draft for the 13U division
        4. Assist in the All Star coach and team selection in the 13U division
        5. Be the main point of contact for coaches and parents in the 13U division
      8. 14/15
        1. Assist in the coach assignment for the 14/15 division
        2. Run the tryouts for the 14/15 division
        3. Assist in the draft for the 14/15 division
        4. Assist in the All Star coach and team selection in the 14/15 division
        5. Be the main point of contact for coaches and parents in the 14/15 division
      9. 16/18
        1. Assist in the coach assignment for the 16/18 division
        2. Run the tryouts for the 16/18 division
        3. Assist in the draft for the 16/18 division
        4. Assist in the All Star coach and team selection in the 16/18 division
        5. Be the main point of contact for coaches and parents in the 16/18 division
    2. The following are additional General Board positions not tied to specific age groups:
      1. Sponsorships
      2. Chief Digital Officer
      3. President Elect - Must be elected
  4. Elections
    1. Elect Board positions will be filled via election by the Elect and General Board of Riverton Baseball in the month of May.
      1. Any office vacancy filling falling outside a regularly scheduled voting cycle must be approved and appointed by a majority vote of the Elect Board.
    2. Duration of the Office
      1. Each office will last for a period of two years
        1. The following offices will be up for election in even numbered years:
          1. President
          2. Snack Shack Manager
          3. Treasurer
          4. Drafted Division President
        2. The following offices will be up for election in odd numbered years:
          1. Umpire-in-Chief
          2. Secretary
          3. Equipment Manager
          4. AAA Intact President
          5. President Elect (Note: To be eligible for this position you must hold a Board position for at least two years prior to running.)
    3. An Elect Board member may only be elected to an Elect Board position for two consecutive terms. After two consecutive terms have been completed the board member may hold any General Board position. If the board member would like to run for an Elect Board position, they must be on the Elect or General Board for two consecutive years.
    4. Amendments
      1. These bylaws may be amended at any Riverton Baseball Elect Board Meeting by a two-thirds vote of the Riverton Baseball Elect Board members present.
    5. Voting Restrictions
      1. In the event that there are spouses on the Elect or General Board, they are allocated one vote.

ARTICLE VII: GAME PLAY

  1. The official playing rules, as published by the Wasatch Baseball Leagues organization, shall be binding on the league. The Riverton Baseball In-House Rules will supersede all other rules.
  2. Once teams are filled, a waiting list will be generated for any late sign ups. Any player that signs up after the draft has taken place will be placed on the next team with availability according to the draft order. Special circumstances will be considered by the Board.
  3. Any players playing up to the next age group shall only be eligible to play in that age group for All Star play. Players playing up may only play up one age group, with the exception of T-Ball, Rookie 5 and Rookie 6.
  4. Practice times will be established and signup will be available online prior to the draft. Team practices will not be allowed on CR Hamilton fields after the first regular season game.
  5. When possible we will schedule preseason developmental games as practice games with development umpires.
  6. Each Home Team will be responsible for providing someone to run the scoreboards and GameChanger during their game.
  7. Any disciplinary actions taken against a player by a coach must be approved prior to game time by the league President or division VP (i.e. missed practice, improper behavior, etc.).
